Is whether or not the design in question is protected by someone other than Barry.There is no clear answer here (that I'm aware of). I really don't think we'll find a definitive answer here, as it would likely involve lawyers.
What's even worse, I don't think we'll ever find out the answer unless a production run of the design in question is made, and a challenge is made by whoever believes they own the rights to the design.
The only thing we do know is that no patent owners of similar designs have posted here. Judging by the nature of the posts by the folks who are advocating group purchases, I'm willing to be it would take no more than a single post from a patent owner simply stating, "Hello, I own patent #????? and a group purchase of the design in quesiton would infringe on my patent." to stop any group purchases. Instead, we seem to have a lot of speculation from folks who, while they may know what they're talking about, don't qualify as patent law experts.
In case it isn't crystal clear, the short of what I'm saying is that if the group purchase is legal, it should happen and people shouldn't be bothered by it. If it is not legal, it should not happen, and I'm sure that if it were clear that it was not legal, none of the folks here would be advocating it. I also don't think we're going to find out from this forum alone whether or not the GP in question is legal or not.
