Could very well be his defense.

Kind of like, I took an assault rifle somewhere that was in chaos, placed myself in physical danger, but never intended to shoot three people. It was self-defense.
"There was a big fight, I got out of there as fast as I could because I was afraid for my life. The car went out of control, through the barricades, and into the xmas parade. I never intended to run over anybody."
There only has to be reasonable doubt in the minds of the jurists. Self-defense is one argument that often seems to work.
