RE: Why should we "mitigate"or "forgive"?...

many criminal defendants are out on bail awaiting trial which could take years because of the backlog of cases. The pandemic shut down jury trials in most jurisdictions. Labs that test evidence, which were already backlogged before the pandemic, are even slower now. Some criminal defendants might walk before trial if they have an aggressive defense lawyer pushing speedy trial rights. DAs are in a bind and have to offer plea deals with only probation/restitution. Except for SCOTUS, nobody really keeps up with what's going on in our judicial branch.
