My question is whether it is the 1970's recording that you think it is or an earlier one? The reason being that HDTT usually offer recordings now in the public domain for copyright reasons. A 1970s recording will still be protected.BTW, probably the best Enigma on record is the Norman Del Mar version with the RPO on DGG. A somewhat "wet" acoustic but well worth heariing.

Says released in '71. I don't know how they get around copyright issues unless reel to reels weren't protected. There are a lot of post 60s recordings on offer.
Maybe they just licensed it ? Of course there may be various loopholes as USA copyright is a law unto itself (literally) and doesn't always follow international standards. This can cause difficulties from time to time as international copyright standards tend towards reciprocity for obvious economic reasons. For example over many years USA recordings were only protected in many other countries because they were " simultaneously" published in Canada.
Copyright does not normally depend upon the medium used so the tape origin would not affect this aspect.
