A consumer fraud claim is based on the inability of the seller to support his claims. FTC rules place a heavy burden on manufacturers and sellers to support their claims, so the only burden that would have been on Steve was to allege the claim made and the lack of support.But that's not really the point here. Steve's comment was sarcastic, but carried a valid message - that being that Bybee has not been able to provide any support for his claims. That was a perfectly legitimate point for Steve to make, and the manner in which he made it was far less offensive than a significant number of Jon's own posts.
This is nothing short of blatant hypocracy and arbitrary censorship on behalf of Jon Risch. Regardless of which side of the issue one finds himself, I cannot believe that any reasonable person who wants AA to be a place where all viewpoints can be expressed and debated, would be anything other than disgusted at Jon's actions, particularly in light of his history of abuse in his position as a moderator and his own personally offensive behavior here and elsewhere.
